trademark is a distinctive sign which identifies certain goods or services as those produced or provided by a specific person or enterprise. Its origin dates back to ancient times when craftsmen reproduced their signatures or “marks” on their artistic or utilitarian products. Over the years these marks evolved into today’s system of trademark registration and protection. The system helps consumers identify and purchase a product or service because its nature and quality, indicated by its unique trademark, meet their needs.
Trademarks may be one or a combination of words, letters, and numerals. They may consist of drawings, symbols, three-dimensional signs such as the shape and packaging of goods, audible signs such as music or vocal sounds, fragrances, or colors used as distinguishing features.
In India, an application for a trademark can be filed for a word mark, device mark, packaging, label, the shape of goods in the form of a textile trademark, collective trademarks, certification trademarks, series trademark, etc. All these marks can be filed in a single class or multiple classes through a single application. In case the applicant claims any particular colour in the marks the same should be indicated in the application.

Use of the Words ‘TM’, ‘SM’ and ®.
‘TM’ stands for Trademark and ‘SM’ stands for Service mark. The use of TM and SM symbols notifies the public that the company is claiming exclusive ownership of the trademark and can generally be used by one who has started using the mark with respect to the goods or has filed a trademark application for the same. The ® symbol, can be used only once the trademark is registered.
